By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 

SECTION 1 - ONLINE STORE TERMS 
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 
You must not transmit any worms or viruses or any code of a destructive nature. 
A breach or violation of any of the Terms will result in an immediate termination of your Services. 

SECTION 2 - GENERAL CONDITIONS 
We reserve the right to refuse service to anyone for any reason at any time. 
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. 
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

DAMAGES:
Please note, all transit related damages must be reported within 10 days of receiving via email with images to hello@ellarboutique.com.au.

Our couriers are amongst the best professionals in Australia and will go to great lengths to ensure this does not happen.

If in the incident you do receive a damaged parcel, please take a photo of the packages and note down the day you received the goods. Please email and forward your images to hello@ellarboutique.com.au and we will organise to collect the damaged goods and send you a replacement.

There will be no refunds for damaged deliveries, we will send a replacement of the same package when possible.

Please note, all transit related damages must be reported within 10 days of receiving via email with images.

FREIGHT:
Ellar Boutique uses multiple couriers to safely transport your gifts. Any delays over and above the mentioned standard shipping lead times are out of our control. You can follow up with the courier company directly with the tracking number and web link provided on dispatch.There are no refunds issued for delays in transit. Ellar Boutique will notify all customers of delays over the standard services.
Each state will have varied delivery lead time.

All gifts will be delivered contactless with AUTHORITY TO LEAVE to the shipping address you provide at checkout. By placing and payng agreeing to ATL, you authorise our courier to leave the package at the specified delivery address without obtaining a signature. Please note that once a package is delivered under ATL, Ellar Boutique is not liable for any loss or damage to the package. We recommend selecting a secure delivery location. If a parcel goes missing after being left at the specified address, any claims or issues must be addressed directly with the courier. We are happy to assist you in filing a claim, but we cannot be held responsible for the loss or offer any refunds or replacements.


SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION 
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. 
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice. 
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. 
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. 

SECTION 5 - PRODUCTS OR SERVICES (if applicable) 
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. 
If a product is not available at the time of purchase, we reserve the right to include a product of equal or higher value. Products are subject to availability and at times may differ in colour. We may swap out the product purchased for the exact same item in a different colour or variant if unavailable at the time of purchase. Products are subject to supplier availability. 
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

SECTION 6 - ACCURACY OF BILLING, ACCOUNT INFORMATION AND LATE PAYMENTS
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 

If any invoiced amount is not received to Ellar Boutique by the due date outlined on the invoice, then these charges will accrue a late interest charge at 1.5% of the outstanding balance per month or the maximum rate permitted by law.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

How do we use your personal information?
We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

SECTION 21 - COMPETITION TERMS AND CONDITIONS

Ellar Boutique ( ABN 71 634 180 680), is the promoter of this competition and hereafter in the terms and conditions will be referred to as the ‘Promoter’. By entering this competition you confirm that you have read and understood these terms and conditions and agree to them. The major prize is supplied by Ellar boutique. 

  1. The major prize consists of two picnic baskets to be allocated to the prize winner. Total value of the major prize is estimated at $229 per gift. 
  2. The prizes are not transferable or exchangeable and are not redeemable for cash or in any other way. 
  3. To enter the competition, simply follow the Ellar Boutique Facebook or Instagram page and reply to the Facebook OR Instagram competition post.
  4. The winner of the major prize will be notified by Facebook or Instagram, and be responsible for arranging the delivery of the prize within 2 days. If the winner fails to arrange the delivery of the prize within the said 2 days, the Promoter reserves the right to withdraw the prize from the winner and randomly select a new winner. 
  5. Entry to the competition is free. 
  6. Entry to the competition is open to persons over the age of 15 years. Employees of the Promoter and their immediate families are not eligible to enter. 
  7. The competition will close at 5pm sharp (Queensland time) on August 31 2022
  8. The winning entry will be drawn at random at 12pm on September 1 2022. The draw will be randomly selected and witnessed by a representative of the Promoter. The winner will be notified via Facebook or Instagram.
  9. The Promoter of this competition reserves the right to seek verification of the winner’s age and identity and other relevant information. The Promoter’s decision is final and correspondence will not be entered into. 
  10. Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence), for any loss or damage of any nature arising out of the Promotion, including, without limitation, any variation in the value of the prize, any tax liability incurred by an entrant and any use of the prize.

  3. Entry to the competition is free.

SECTION 23 - FREE BRANDED WATER BOTTLE WITH EVERY CUSTOM CHRISTMAS GIFT ORDER - TERMS AND CONDITIONS - Offer ends 15/8/24
Ellar Boutique (ABN 71 634 180 680) is the promoter of this offer, hereafter referred to as the "Promoter." By participating in this promotion, you confirm that you have read, understood, and agree to these terms and conditions.

Eligibility:

  • This promotion is open to individuals over the age of 18. Employees of the Promoter and their immediate families are not eligible to participate.
  • To qualify, customers must place an order for a minimum of 100 custom “Create Your Own” Christmas gifts, with a minimum spend of $110 (excluding GST) per gift.
  • The promotion is limited to the first 25 customers who meet these criteria.

Offer Details:

  • Customers who qualify will receive a free luxury soft-touch insulated branded water bottle with every custom gift ordered.
  • The value of each bottle is estimated at $33, resulting in a total savings of $3,300+.
  • The offer is valid for orders placed and paid for between September 6th, 2024, and October 15th, 2024.

Logo Submission and Approval:

  • Logos must be provided in a high-resolution EPS format. The Promoter will recommend horizontal and vertical logo dimensions based on design and printing requirements.
  • Customers will receive a digital mockup for approval before proceeding to production. Approval must be given in writing.

Delivery:

  • The free water bottles will be delivered separately in bulk to one nominated company address, not alongside the custom gifts.
  • The Promoter may offer expedited delivery for an additional fee, subject to production and shipping timelines.
  • Delivery of free bottles before Christmas cannot be guaranteed. However, they will be dispatched as soon as they are available.

Quality Assurance:

  • All branded water bottles and custom gifts are subject to quality assurance processes.
  • Any issues with the products must be reported within 7 days of receipt to discuss a resolution.

Returns and Exchanges:

  • Custom gifts and branded water bottles are non-returnable and non-exchangeable, except in cases of manufacturing defects or errors in printing.

Modification and Cancellation:

  • Orders can be modified or canceled up until final design approval. Once production begins, no further changes, cancellations, or refunds can be made.

General Conditions:

  • This promotion cannot be combined with other offers, discounts, or promotions unless explicitly stated.
  • The Promoter reserves the right to modify or withdraw the promotion at its discretion without prior notice.
  • The competition is governed by the laws of Queensland, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts in Queensland.

SECTION 24 - USE OF LOGOS
By providing your logo for branding purposes, you grant Ellar Boutique the right to use your logo on the ordered products and associated marketing materials, including our website, social media platforms, and promotional materials, to showcase our work. If you do not wish for your logo to be used in this way, please notify us in writing at the time of order. We respect your brand and will only use your logo in a manner that reflects positively on your business.

SECTION 25 - FREE UNLIMITED BRANDING TERMS AND CONDITIONS - CHRISTMAS 2024

Ellar Boutique (ABN 71 634 180 680), referred to as the "Promoter," offers a promotional "Free Unlimited Branding" service under the following terms and conditions. By participating in this promotion, you confirm that you have read, understood, and agree to these terms and conditions.

Eligibility:

  1. Qualifying Orders: The free unlimited branding offer is valid for all orders of 4 or more gifts placed after September 2nd 2024, for the duration of the promotion.
    The unlimited free branding offer excludes non-Christmas items and custom-created gifts with Ellar Boutique.
  2. Minimum Purchase Requirement: To be eligible for free branding, customers must order at least 4 units of any qualifying gift product(s) listed on the Ellar Boutique website. Please note: A minimum order of 6 units is required for our Limited Edition Gold Foil Cylinder gifts.
  3. Logo Submission: Customers are required to provide a high-resolution EPS logo file. If an EPS file is not available, it may cause delays in the branding and production of your order. Ellar Boutique offers a graphic design service for $79 + GST to create a high-resolution EPS logo. This process typically takes 1-2 business days after payment is received. To create the EPS, we will need your existing logo, and we will send you the newly created EPS file once it’s ready.

Offer Details:

  1. Branding Scope: The promotion covers branding on gifts, packaging, tags, or boxes as outlined in the specific product description.
  2. Branding Locations: Free branding is limited to predetermined areas on the product as specified by Ellar Boutique. Additional branding or customisation beyond the offered scope will incur additional costs.
  3. Design Approval: All customers will receive a digital mockup of the branded product for approval. Production will not commence until written approval of the design is received. The Promoter is not responsible for any delays caused by late approvals.

Delivery:

  1. Delivery Times: Delivery timelines may vary based on the volume of the order and the time of approval. Ellar Boutique will endeavor to meet delivery deadlines but cannot guarantee delivery by a specific date unless explicitly confirmed in writing.
  2. Shipping: Free delivery is included with this offer for orders delivered to a single address. Split deliveries or direct-to-recipient deliveries may incur additional charges.

Additional Terms:

  1. Non-Transferable: The free branding offer is not transferable and cannot be redeemed for cash or other products.
  2. Promotion Duration: This offer is only valid for orders placed and paid for between 2nd September 2024 and 16th October 2024.
  3. Exclusions: This promotion cannot be combined with any other offers, discounts, or promotions unless explicitly stated.

Modifications and Cancellations:

  1. Changes: Orders can be modified or canceled up until final design approval. Once production begins, no further changes, cancellations, or refunds can be made.

Liability:

  1. Quality Assurance: Ellar Boutique guarantees the quality of the branded items under this offer. Any issues must be reported within 7 days of receipt.
  2. Limitation of Liability: Except for any liability that cannot be excluded by law, Ellar Boutique excludes all liability (including negligence), for any loss or damage arising out of or in connection with this promotion.

Governing Law:

These terms and conditions shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Queensland.

SECTION 26 - REDELIVERY REQUESTS

Redelivery requests will only be considered for items that have been officially marked as "missing" or "undelivered" by the designated courier service.

Customers must allow a reasonable amount of time for the delivery to be attempted, and in case of any delays, they should refer to the courier's tracking information.

If your gift is undelivered and been returned to us please email us hello@ellarboutique.com.au to organise a re-delivery or refund (excluding the delivery fee) for your missing order.
